Terms of Use

The rules for using CargoIA — the account, the plans, acceptable use and the freight data, which stays inside the platform.

Last updated October 25, 2026

These Terms of Use govern the use of CargoIA: the website (https://cargoia.com.br), the platform (https://painel.cargoia.com.br), the CargoIA app for Android, iOS and the browser, the public API and the MCP server — together, the Service. The Service is operated by GENOMA HQ TECHNOLOGY LTDA, registered under CNPJ 49.213.490/0001-01, with its registered office at Avenida Paulista, 1106, sala 01, 16º andar, Bela Vista, São Paulo/SP, CEP 01310-914 ("CargoIA", "we").

By creating an account, accepting an invitation or using the Service, you agree to these Terms and to the Privacy Policy. If you use the Service on behalf of a company, you represent that you may accept them for it; in that case the "Customer" is the company, and "you" are whoever represents it or was invited by it.

The Portuguese version of these Terms prevails over this translation.

1. The Service

CargoIA brings together, for those who buy and sell freight:

  • Freight quotes: the minimum freight floor computed from ANTT's tables (Law 13,703/2018), the tolls on the route and the price per tonne, over a route traced on the road network;
  • Freight history and exchange: the price of a tonne of freight per lane over time, from freight offers published in the market and from Conab's survey;
  • The Customer's saved quotes and freights carried, reports and exports;
  • An AI assistant, which answers questions by looking up the account's data with the permissions of whoever asks;
  • API, MCP and webhooks, to integrate CargoIA with the Customer's systems.

Estimates are references. The floor follows the public tables in force, and market prices are observations of offers published by third parties, which may hold errors, delays or gaps. CargoIA does not guarantee that a freight will be hired at the estimated price, nor does it replace the Customer's own judgment: the Customer must check compliance with transport law and the prices it agrees. Nothing in the Service is financial, legal or tax advice.

2. Account, organizations and access

  • The account belongs to the Customer and holds one or more organizations (branches, operations). The account's administrators invite people, set roles and permissions, assign licenses and create API keys.
  • Each license is for one person. Do not share passwords, sessions or licenses between people.
  • You must give truthful information, confirm your e-mail and keep your credentials and API keys safe. The Customer answers for what is done with its accounts and keys.
  • We may suspend access to protect the Service, the account or third parties — for instance, when a key has leaked or the use breaches these Terms.

3. Plans, payment and cancellation

  • The plans (Pro, Max and Enterprise), what each includes and their prices are on the pricing page. The plan applies to the whole account and is charged per license, in Brazilian reais, monthly or yearly (the yearly plan is paid up front).
  • Payment is processed by Stripe, by credit card. CargoIA neither receives nor keeps card details.
  • Free trial: the Pro plan can be tried for 7 days, once per account, with a card on file. Unless cancelled during the trial, the subscription is charged when it ends.
  • The subscription renews automatically at the end of each period until cancelled.
  • Plan changes: what goes up (another plan, more licenses, yearly billing) applies at once, charging the prorated difference and crediting what was already paid; what goes down applies at the end of the period already paid.
  • Cancellation: an administrator may cancel at any time, and access continues until the end of the period already paid. Amounts for periods already started are not refunded, except where the law requires.
  • Assistant credits: each license has a monthly allowance of assistant use, shown as credits. Once it is reached, the assistant is unavailable to that person until the next month; nothing is charged beyond the plan.
  • If a payment fails, the open invoice shows to the administrator on the billing page; if it remains unpaid, access may be suspended until it is settled.
  • We may change prices and what each plan includes with at least 30 days' notice. The change applies from the first renewal after the notice.

4. Freight data stays in the platform

The price history, the freight exchange and everything CargoIA derives from them are the core of the Service, and they are licensed for use inside the platform.

Market Data means: the market's freight prices and offers, the series and indices per lane, the freight exchange, freight arrivals, analyses, the market references included in a quote, and any information derived from them that CargoIA makes available — through the interface, the app, the API, the MCP server, the assistant, reports or exports.

During the subscription, the Customer receives a limited, non-exclusive, non-transferable and revocable license to consult Market Data in the platform and use it in its own business decisions. It is not permitted to:

  1. copy, extract, scrape, bulk-download or store Market Data outside the platform — in databases, spreadsheets, data lakes, BI tools, CRMs, ERPs or any system of its own or of third parties;
  2. keep a copy or cache of Market Data beyond what is needed to display it at the time it is consulted;
  3. use the API, the MCP server, the assistant or exports to rebuild, replicate or feed a freight price database;
  4. use Market Data to train or fine-tune artificial intelligence models;
  5. resell, sublicense, publish, distribute or give third parties access to Market Data;
  6. combine Market Data with other sources to offer a competing product or service.

A saved quote's PDF may be sent to the Customer's own client in the negotiation of that freight. Reports and exports holding Market Data are for internal, occasional reading; they may not be imported into other systems or kept as a database.

A breach of this section allows us to suspend or terminate the account at once, without prejudice to damages.

This section does not apply to Customer Data (section 5), which belongs to the Customer.

5. Customer Data

Customer Data is what the Customer and its people put into the Service: saved quotes, freights carried, lanes followed, conversations with the assistant, files, settings.

  • Customer Data belongs to the Customer. The Customer authorizes us to process it only to provide, maintain, protect and improve the Service, as the Privacy Policy describes.
  • We do not sell Customer Data, nor use it to feed Market Data.
  • The Customer is responsible for the lawfulness of the data it puts in — especially third parties' personal data, such as its clients' and drivers' contacts. For that data the Customer is the controller and CargoIA acts as processor, under the LGPD.

6. Acceptable use

Besides section 4, it is not permitted to:

  • breach the law or third parties' rights through the Service;
  • try to reach accounts, organizations or data that are not yours, or circumvent permissions, limits and security measures;
  • reverse engineer, decompile or copy the software, except where the law allows;
  • overload the Service, exceed the API's request limits or use robots outside the API and the MCP server;
  • upload malicious code or unlawful content;
  • resell access to the Service or use it to build a competing service.

7. AI assistant

The assistant writes its answers with third parties' artificial intelligence models, from the data the person can see. AI-generated answers may be wrong: check them before deciding on them. Conversations are kept for whoever had them, and their content is sent to the models' providers to generate the answers, as the Privacy Policy describes.

8. API, MCP and integrations

API keys are secret and belong to the account; each holds the permissions and organizations an administrator sets. The API has usage limits per key, described in its reference. We may evolve the API; incompatible changes will be announced reasonably in advance. Everything section 4 says about Market Data applies equally to what is obtained through the API and the MCP server.

9. Intellectual property

The software, the CargoIA brand, the interface, the documentation and the Market Data databases — including their selection, arrangement and the indices computed — belong to CargoIA or its licensors and are protected by copyright, software and industrial property law. These Terms transfer none of those rights beyond the license of use described here. Suggestions you send us may be used freely.

10. Availability and support

We work to keep the Service available and secure, but it may undergo maintenance and outages, and it depends on third-party services (such as hosting, maps, payments and AI providers). Unless an Enterprise contract says otherwise, the Service is offered without a guaranteed service level. We may change, add or remove features; if we remove something essential from a paid plan, we will give notice first.

11. Liability

To the extent permitted by law:

  • we are not liable for lost profits, lost business or indirect damages, nor for decisions made on estimates, market prices or the assistant's answers;
  • our total liability, for any cause, is limited to the amount the Customer paid in the 12 months before the event.

These limits do not apply to wilful misconduct or gross negligence, nor do they remove rights the Consumer Protection Code grants to whoever is a consumer.

12. Suspension and termination

The Customer may end the subscription whenever it wishes and delete the account in Settings. We may suspend or terminate access for breach of these Terms, non-payment or legal requirement. When the subscription ends, Customer Data remains stored while the account exists; deleting the account erases the organizations and their records from the platform.

13. Changes to these Terms

We may update these Terms. Material changes will be announced by e-mail or in the Service at least 15 days in advance; continuing to use the Service after that means agreeing to the new version. The date of the last update is at the top of this page.

14. Governing law and venue

These Terms are governed by the laws of Brazil. The courts of São Paulo/SP are chosen to settle any dispute, without prejudice to a consumer's right to sue in the courts of their domicile.
